Due to a number of calls regarding the Los Angeles Fair Chance Ordinance, we are resending the December 2016 notification.
The Los Angeles Fair Chance Initiative for Hiring (the “Ordinance”) is the latest in Ban the Box initiatives and impacts Los Angeles based employers and those with employees performing work in the City of Los Angeles. The new ordinance does not prohibit employers from conducting criminal background checks. However, under the new rules an employer may not ask about an applicant’s criminal history, use any mode of communication, nor conduct a criminal background check until after extending a conditional offer that is only conditioned on the result of the check.
The Los Angeles Fair Chance Initiative for Hiring (the “Ordinance”) became effective on January 22, 2017; however, it will not be enforced until July 1, 2017.
