The new year is here! For HR that means a whole set of new compliance requirements.
HR is faced with many compliance requirements whether it be COVID protocols, EEOC regulations, equal pay, wage and hour laws, workers compensation, managing employee classification, and the list goes on.
When it comes to your employment screening program, you are required to comply with FCRA, state and local jurisdiction requirements, Ban the Box restrictions, drug testing compliance, I-9 Form compliance requirements, e-Verify process requirements, just to name a few.
If you are in the transportation industry or have your own fleet of trucks, your organization must follow the DOT employment screening and drug screening requirements. If you are in the healthcare industry, there are a number of compliance requirements that vary by sector.
We can all agree that keeping up with compliance requirements is critical to protecting your organization, your employees and customers. In fact, in a recent study published by the HR.com Research Institute, 65% of HR professionals “rank their organizations highly in regard to maintaining an up-to-date understanding of all compliance issues.” That’s good news, but there is room for improvement. Compliance can be costly. There are significant financial penalties if an organization is not in compliance with HR regulations, which is the biggest concern for companies in keeping up with the ever-changing requirements.
How do you keep up to date with all of the compliance requirements? The HR.com survey found that 70% of HR professionals “spend more than a quarter of their average workweek managing issues related to regulatory and legal compliance”. That’s a significant amount of time!
When asked how HR departments stay up to date with compliance, there were 3 methods that were cited most often:
- Consulting with outside or in-house counsel or other compliance specialists
- Maintaining membership in business organizations
- Reading relevant material on websites
According to the survey, the 3 most common challenges with keeping up to date with compliance related laws are:
- Technology failing to keep up with compliance changes
- Lack of staff to implement changes
- Lack of in-house expertise
The survey also found only 46% of companies surveyed have integrated systems in place to manage their compliance processes and only 40% said their compliances processes are automated.
