Consumer Rights

The federal Fair Credit Reporting Act (FCRA) governs the consumer reporting industry, including employment related background checks. As a subject of a consumer report, you should be familiar with your rights as outlined in the CFPB’s document: A Summary of Your Rights Under the Fair Credit Reporting Act.

Numerous states also have consumer reporting laws regarding consumer reports for employment purposes. These laws typically protect the consumer in their state of residence. For more information on whether your state offers additional rights beyond those provided in the Fair Credit Reporting Act (FCRA), check with your state’s Department, Division, or Office of Consumer Affairs.
